These Terms of Service govern your use of safetyvest.com.au and all products and services offered by Sands Industries (ABN: 30 629 811 383, ACN: 629 811 383) trading as SafetyVest.com.au.

Important: Nothing in these Terms excludes your rights under the Australian Consumer Law. Our products come with guarantees that cannot be excluded, restricted or modified by law. If something goes wrong, we will make it right.

By accessing or using the website, placing an order or otherwise engaging with us, you acknowledge that you have read, understood and agree to be bound by these Terms.


1. DEFINITIONS

Order — A confirmed purchase of one or more products made through the website, by phone, email or in writing.

Custom Order — Any order involving custom printing, embroidery, heat transfer, DTF printing or any other branding or personalisation of a product.

Proof — A digital visual representation of a Custom Order submitted to the Customer for approval prior to production.

Artwork — Any logo, design, text, graphic or image file provided by the Customer for use in a Custom Order.

Products — Hi-vis safety vests and related workwear items offered for sale on the website.

GST — Goods and Services Tax as defined in the A New Tax System (Goods and Services Tax) Act 1999 (Cth).

ACL — The Australian Consumer Law, as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Working Days — Monday to Friday, excluding Australian public holidays.


2. ORDERS & CONTRACT FORMATION

An order placed by you constitutes an offer to purchase products in accordance with these Terms. A binding contract between you and Sands Industries is formed when we send you a written order confirmation by email or other written means.

We reserve the right to decline or cancel any order at our discretion, including where the product is no longer available or is out of stock, where we are unable to verify payment authorisation, where the artwork submitted is unlawful, defamatory or infringes intellectual property rights, or where there is a material error in the price displayed on the website.

Where we cancel an order, we will promptly notify you and issue a full refund of any payment received for that order.

No Minimum Order: We accept orders of any quantity — from a single vest to large fleet orders. The same quality standards and production processes apply regardless of order size.

Order Changes: Changes to an order after confirmation are accepted at our discretion and only where production has not yet commenced. Change requests must be submitted in writing to sales@sandsindustries.com.au. Changes may affect pricing and delivery timelines. Once a Proof has been approved by you, the order is locked for production and cannot be changed without incurring additional production costs.

Cancellations: Orders for standard non-custom products may be cancelled at any time before dispatch, with a full refund. Custom Orders may be cancelled without penalty before a Proof has been sent. Once a Proof has been sent, cancellation will incur a production setup fee of up to 30% of the order value. Once production has commenced, Custom Orders cannot be cancelled and no refund will be issued, except as required by the ACL.


3. CUSTOM ORDERS & ARTWORK

Artwork Submission: For Custom Orders, you must supply artwork in an accepted file format. We accept AI, EPS, PDF and SVG vector formats (preferred) and PNG or JPEG files at a minimum of 300dpi at the intended print size. Artwork may be submitted by email to sales@sandsindustries.com.au or uploaded via the website.

Artwork Ownership and Licence: By submitting artwork to us, you represent and warrant that you own, or have the right to use, all intellectual property in the submitted artwork, that the artwork does not infringe any third-party intellectual property rights including trademarks, copyright or registered designs, that the artwork does not contain unlawful, offensive or defamatory content, and that you grant us a non-exclusive licence to reproduce the artwork solely for the purpose of producing your Custom Order.

We reserve the right to decline to produce any Custom Order where, in our reasonable opinion, the artwork may infringe third-party intellectual property rights or is otherwise unlawful.

Proofs and Approval: Before commencing production of any Custom Order, we will send you a digital Proof for your review and approval. You must review the Proof carefully and respond with either written approval confirming the Proof is correct and production may proceed, or a correction request with specific written instructions for any changes required.

Proof Approval is Final: Once you have approved a Proof in writing, Sands Industries accepts no liability for errors in the finished product that were present in the approved Proof — including spelling errors, incorrect colours, incorrect sizing of logos or incorrect placement. You are responsible for thoroughly checking all elements of the Proof before approving it.

Proofs are provided within one business day of receiving your complete order and artwork. If we do not receive a response to a Proof within seven business days, we reserve the right to cancel the order and retain any deposit paid to cover the cost of artwork preparation.

Colour Accuracy: Digital Proofs are for layout and design approval only. Colour reproduction on screen versus physical production will vary due to differences between screen colour profiles and print production colour models. We will make reasonable efforts to match your brand colours, but we cannot guarantee exact colour matching unless a Pantone reference is agreed in advance. Slight variations in colour between the Proof and the finished product are not grounds for a return or refund.


4. PRICING, GST & PAYMENT

Pricing: All prices displayed on the website are in Australian Dollars (AUD) and are inclusive of GST unless expressly stated otherwise. Prices are subject to change without notice. The price applicable to your order is the price confirmed at the time your order is accepted by us in writing.

Volume discount pricing is automatically applied at the following thresholds: 25, 50, 100, 250 and 500 or more units. The applicable price will be displayed during the order or quoting process.

No Hidden Fees: We do not charge setup fees, artwork handling fees or account creation fees. Shipping costs are quoted separately and will be confirmed before your order is finalised. Any applicable surcharges such as remote area delivery fees will be disclosed before payment.

Payment: Payment in full is required before production commences on Custom Orders, unless a separate credit arrangement has been agreed in writing. We accept credit card (Visa and Mastercard) via our secure payment gateway, bank transfer (EFT) to our nominated account with details provided on invoice, and PayPal where available. Bank transfer payments must clear before production commences. We are not liable for production delays resulting from delayed EFT clearance.

GST: All supplies made by Sands Industries are subject to GST in accordance with the A New Tax System (Goods and Services Tax) Act 1999 (Cth). A tax invoice including GST details will be provided with every order.


5. DELIVERY & SHIPPING

We ship to all states and territories of Australia including metropolitan, regional, rural and remote areas. Delivery timelines begin from the date of Proof approval for Custom Orders, or from the date of payment for standard non-custom orders.

Standard non-custom vests: 3 to 7 business days from payment. Custom Orders with screen print, heat transfer or DTF: 7 to 14 business days from Proof approval. Custom Orders with embroidery: 10 to 16 business days from Proof approval. Large volume orders of 250 or more units: timeline confirmed at quoting stage. Express production where available: confirmed on request and a surcharge may apply.

Delivery timeframes are estimates only and are not guaranteed. Sands Industries is not liable for delays caused by third-party courier services, adverse weather, public holidays or other circumstances beyond our control. All shipments are sent via tracked courier service and tracking information will be provided once your order has been dispatched.

Delivery Responsibilities: You are responsible for providing an accurate and accessible delivery address. If a delivery is returned to us due to an incorrect address or missed delivery attempts, re-dispatch will be at your expense. Risk in the products passes to you upon delivery to the address you provided.

Short Deliveries and Missing Items: If your order arrives incomplete, please contact us within five business days of the delivery date. We will investigate and rectify any genuine shortfall at no additional cost to you.


6. PRODUCT COMPLIANCE & FITNESS FOR PURPOSE

All products supplied by Sands Industries are manufactured to comply with AS/NZS 4602.1:2011 (High Visibility Safety Garments) and AS/NZS 1906.4 (Retroreflective Materials). Compliance labels are permanently attached to all garments.

While we take all reasonable steps to ensure our products comply with the applicable Australian Standards, it is the Customer’s responsibility to select the appropriate vest class — D, D/N or R — for the specific worksite and hazard environment, to verify that the selected product meets any site-specific safety management plan requirements which may exceed the minimum AS/NZS 4602.1 class, to ensure products are used, maintained and replaced in accordance with manufacturer instructions and AS/NZS 4602.1 guidance, and to check that flame-resistant, antistatic or other specialist requirements are correctly specified at the time of ordering.

Sands Industries is not liable for injury, loss or damage arising from the selection of an incorrect vest class, from use of a product contrary to the care instructions, or from continued use of a product that has degraded beyond its compliant service life.


7. INTELLECTUAL PROPERTY

All intellectual property in the website — including text, images, graphics, layout, source code and the SafetyVest.com.au name and logo — is owned by or licensed to Sands Industries and is protected by Australian and international intellectual property laws. You may not reproduce, adapt, distribute or publish any content from the website without our prior written consent.

You retain ownership of all intellectual property in artwork you submit to us. You grant us a limited, non-exclusive, royalty-free licence to use your artwork solely for the purposes of producing your Custom Order. We will not use your artwork for any other purpose, including marketing or display, without your explicit written consent.

We may from time to time display photographs of completed Custom Orders for marketing and portfolio purposes. If you do not wish your order to be used in this way, please advise us in writing when placing your order and we will respect that request.


8. LIMITATION OF LIABILITY

To the fullest extent permitted by law and subject to your rights under the Australian Consumer Law, Sands Industries’ total liability to you in relation to any one order or series of related orders is limited to the amount paid by you for that order.

Sands Industries is not liable for any indirect, consequential, special or incidental loss or damage of any kind, loss of profits, revenue, business or anticipated savings, damage to reputation or goodwill, loss arising from delays in delivery caused by third-party carriers, loss arising from a Customer’s selection of an incorrect product for their compliance requirements, loss arising from errors in an approved Proof that was approved in writing by the Customer, or loss arising from force majeure events including natural disasters, government restrictions, pandemics, industrial action or supply chain disruption.

Nothing in this clause limits, excludes or modifies any consumer guarantees provided under the Australian Consumer Law that cannot be excluded by law.


9. AUSTRALIAN CONSUMER LAW

Our products and services come with guarantees under the Australian Consumer Law that cannot be excluded.

Under the ACL, you are entitled to goods that are of acceptable quality — meaning safe, durable, free from defects, acceptable in appearance and fit for all the purposes for which goods of that kind are commonly supplied. You are entitled to goods that match the description given, the sample shown or the demonstration model. You are entitled to goods that are fit for any particular purpose you made known to us before purchase. You are entitled to goods supplied with clear title and without interference by third parties. You are entitled to a guarantee that spare parts and repair facilities will be reasonably available.

If our products fail to meet a consumer guarantee, you are entitled to a remedy under the ACL.

For a major failure — where the product has a problem that would have stopped you buying it had you known, or it is significantly different from its description, or it is substantially unfit for purpose — you may reject the goods and receive a full refund or replacement, or keep the goods and receive compensation for the reduction in value.

For a minor failure — where the problem can be fixed — we are entitled to choose between providing a repair, replacement or refund.


10. RETURNS, REFUNDS & REPLACEMENTS

In summary: standard non-custom products may be returned within 30 days of delivery if they are unused, unwashed and in original condition. Custom Orders cannot be returned or exchanged unless they contain a manufacturing defect, are materially different from the approved Proof, or fail to meet a consumer guarantee under the ACL. If you receive a faulty or misdescribed product, please contact us within 5 business days of delivery at sales@sandsindustries.com.au with photos and your order number.


11. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia. You and Sands Industries submit to the non-exclusive jurisdiction of the courts of New South Wales and the federal courts of Australia for the resolution of any dispute arising under or in connection with these Terms.
